TERMS AND CONDITIONS – PILLZET

These Terms and Conditions (“Terms”) govern access to and use of the PillZet mobile application and website
https://pillzet.in (“Platform”), operated by PillZet (“Company”, “we”, “us”, “our”).
By accessing or using the Platform, you agree to be bound by these Terms.
1. PLATFORM ROLE & NATURE OF SERVICES (CORE CLAUSE)
PillZet is a technology-based marketplace platform that facilitates the discovery, ordering, and payment of pharmaceutical and healthcare products offered by third-party licensed pharmacies (“Sellers”).
PillZet does NOT:
- Own, stock, store, sell, dispense, distribute, or manufacture medicines
- Act as a pharmacy, chemist, or healthcare provider
All medicines and healthcare products are sold, dispensed, and fulfilled solely by Sellers under their respective licenses and in compliance with applicable laws.
2. ELIGIBILITY
- Users must be 18 years or older
- By using the Platform, users confirm that all information provided is accurate and lawful
3. SELLER RESPONSIBILITY & LIABILITY SHIFT
Each Seller is solely responsible for:
- Authenticity, quality, safety, and legality of products
- Pricing, taxes, invoices, and statutory disclosures
- Prescription validation and lawful dispensing
- Packaging, delivery, and returns (as per applicable law)
PillZet shall arrange for delivery within the committed timeline but shall not be responsible or liable for adverse drug reactions post delivery of the exact medicine ordered through prescription or without prescription.
4. PRESCRIPTION MEDICINES & REGULATORY COMPLIANCE
Prescription medicines require a valid prescription issued by a Registered Medical Practitioner in accordance with applicable laws.
All prescriptions uploaded may be reviewed and verified by PillZet’s licensed Clinical Pharmacologists for completeness, authenticity, and regulatory compliance.
Prescriptions may be accepted, rejected, or cancelled at the discretion of the Seller or PillZet to ensure patient safety and legal compliance.
Reuse, alteration, tampering, or submission of forged or invalid prescriptions is strictly prohibited.
Schedule X, habit-forming, or other prohibited medicines shall not be listed or dispensed through the Platform.
PillZet reserves the right to cancel or suspend any order that violates applicable drug laws, pharmacy regulations, or Platform policies.
5. NO MEDICAL ADVICE DISCLAIMER
All information available on the Platform is provided for informational purposes only.
PillZet does not provide medical advice, diagnosis, or treatment.
Users must consult qualified healthcare professionals before consuming any medicines.
6. INTERMEDIARY
PillZet is an “intermediary” under Section 2(1)(w) of the Information Technology Act, 2000 and is entitled to safe-harbour protection under Section 79.
PillZet does not initiate, select, modify, or control Seller content, listings, or pricing.
7. PAYMENTS
All payments on the Platform are processed through authorized third-party payment gateways, banks, or payment aggregators (“Payment Partners”).
PillZet collects payments only as a technology intermediary and payment facilitator on behalf of Sellers and does not own or control the products listed.
Upon successful payment, the applicable amount shall be settled with the respective Seller, subject to disclosed platform fees, taxes, or charges.
PillZet is not responsible for any loss, delay, or failure in payment settlement caused by Payment Partners.
Refunds, cancellations, and disputes shall be governed by the PillZet Refund and Return Policy and applicable laws, and resolved between the User, Seller, or Payment Partner.
Pricing, invoicing, and payment disputes must be resolved directly with the Seller. PillZet’s role is limited to facilitation and communication.
8. DELIVERY & LOGISTICS DISCLAIMER
- Delivery timelines are indicative and best-effort
- Third-party logistics partners may be used
PillZet will manage customer communication for delays. Once medicines are dispatched, any loss or damage during transit shall be the sole responsibility of the logistics partner, not PillZet.
9. USER CONDUCT
Users shall not:
- Misuse prescriptions
- Upload false or misleading information
- Abuse Sellers, pharmacists, or delivery staff
- Violate applicable laws or IT Rules, 2021
10. TERMINATION & SUSPENSION
PillZet may suspend or terminate access without notice in cases of legal violations, fraud, misuse, or platform security risks.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law, PillZet shall not be liable for indirect, incidental, or consequential damages.
Total liability, if any, shall not exceed the platform convenience fees paid or ₹100, whichever is lower.
12. INDEMNITY
Users agree to indemnify PillZet against claims arising from prescription misuse, legal violations, or false information provided.
PillZet shall indemnify users only to the extent of the value of the medicine ordered through the Platform.
13. GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of India.
Exclusive jurisdiction shall lie with the courts of Hyderabad, State of Telangana.
14. GRIEVANCE REDRESSAL
Grievance redressal details shall be published on the Platform in accordance with applicable laws.
